One Year after the Implementation of the New Company Law: Observations, Practice and Takeaways

With the end of the five-year transition period under FIL (Foreign Investment Law), and upon the implementation of the New Company Law (effective as of July 1st, 2024) introducing significant changes in company governance model, capital contributions, registration and publicity, foreign-invested enterprises (FIEs) need to prepare for a new era of compliance. During this Seminar, we will share some observations, practice and takeaways of FIE in the past one year after the implementation of the New Company Law.
We'll focus on hot topics such as:
- What will be the impact if necessary amendments have not been made to the AoA of FIE before the end of the five-year transition period under FIL?
- If a FIE has to set up an Employee Supervisor (or even Employee Director), what are the applicable requirement and procedure for election of such Employee Director/Supervisor?
- Practice and solutions of directors and supervisors dealing with increasing liabilities under the New Company Law
